§ 1. Definitions
Licensor - Andrzej Orchowski, doing business as Orcan, registered in EDG, J??zef??w, Poland, phone: +48 22 350 60 01, email: elka@orcan.com.pl.
Software - executable code for the English-language version of ELKa - the application supporting diet self-control, and any accompanying distributable data and executable files.
Use - load Software to computer's CPU, memory or storage.
User - the person who makes use of the Software.
Trial Period - a period of twenty days from the date of first use.
§ 2. License
Software is protected by the Polish copyright law and other applicable national and international laws and treaties. Software is provided by Licensor to use by the User under the terms of this License. Any this Software other then as authorized under this License is prohibited. All rights of any kind in Software which are not expressly granted in this License are entirely and exclusively reserved to and by the Licensor.
Software utilizes public domain USDA National Nutrient Database for Standard Reference.
Subject to the terms of this License, Licensor grants User a limited, non-exclusive, non-assignable, non-transferable license to use software, solely for personal non-commercial purpose
- royalty-free for the Trial Period;
- Perpetual period in case of new purchases of Software provided that Licensor receive full payment of the applicable license fee.
The payable License is granted to User (identified by the User Name, provided by User during a registration process) to use Software on the only one computer (identified by the Registration Number, assigned by Software during Software installation setup).
§ 3. Disclaimer
User may not
- rent, lease, loan, sell, or sub license, Software, in whole or in part;
- modify, translate, reverse, decompile, disassemble Software
nor permit anyone else to do so;
- remove, alter or obscure any Software identification, trademark, copyright,
and confidentiality, proprietary or other notices contained on or within Software.
§ 4. Limit of Liability
Subject to any liability, which may not be excluded, or limited by law, The licensor shall not be liable and hereby expressly excludes all liability for loss or damages howsoever and whenever caused to User.
