All prices are displayed including VAT and exclusive of delivery charges. The information displayed in Orcan Web Shop, including prices, does not constitute an offer to contract or enter into an agreement. The merchandise goods are brand new and under the terms of manufacturer's warranty on the warranty card. The digital goods are copyrighted according to individual copyright notices. The VAT Invoice proof of purchase is issued according to the provided billing data. You agree to receive the VAT Invoice in a digital form without the issuer signature. III. Placing an Order When placing an order You will be required to provide information about Your billing (and optionally shipping) data including Your name, telephone number and e-mail address, which is true, accurate, current and complete in all respects. The Orcan Web Shop checkout process is pursued by PayPal. You confirm You understand and do accept that the payment for the order is made to the gateway account and Orcan is not liable for the payment up to the moment it is reaching gateway's Orcan Web Shop account. Orcan Web Shop will notify You by e-mail as soon as it gets payment confirmation from the gateway You selected, to acknowledge receipt of Your order and to provide You with an order number. Acceptance of Your order shall only take place when the gateway transfered the payment to the Orcan Web Shop account. Until then Orcan Web Shop reserves the right to decline the order. No binding contract is created until Your order has been accepted. IV. Shipment Shipment is usually made within one business day after accepting an order. Shipment is made by selected courier (Polish Post) and service (economic or priority, insured if available). Shipment time is regulated according to courier's Terms and thus Orcan Web Shop ability to guarantee delivery period is restricted. If You receive a damaged shipment, claim demages in written according to Your local Post procedures and fax it to us to accept reimburse, refund or replace. Under no other circumstances You can claim for damaged goods reimbursement. V. Return Policy and Cancellation If You have purchased a factory defected good You should contact Orcan Web Shop to replace it. A new one, free from defects will be sent to You within 14 days from the date of receiving returned one. Delivery Costs is borne by the consignors. If for any reason You enforce Your right of rescission, You can return it within 10 days counting from the day following delivery, providing it has not been used and is in its original packaging. Please make sure You take reasonable care of the item while it is in Your possession and notify us of Your wish to return. Delivery Cost is borne by You. Within 14 working days of receiving it, we reimburse complet payments for goods. If a return shipment contains damaged or used goods, Orcan Web Shop is authorized to enforce damage compensation claims. Digital goods purchase is excluded from cancellation. No refund will be offered relating to the purchase of digital materials. VI. Liability Orcan makes no representations or warranties in connection with Orcan Web Shop, whether express or implied, including but not limited to warranties of non-infringement or fitness for a particular purpose, except to the extent such warranties are not legally excludable. To the fullest extent permissible Orcan will not be liable for loss or damages of any kind incurred as a result of dealings with or any malfunction which may occur in connection with Your use of Orcan Web Shop or its merchandise, any inaccuracies or omissions or misleading, false or deceptive statements in the content, or any events beyond Orcan reasonable control.
